    1. Acceptance of Terms

    By accessing or using PREPULSE, whether through the web application (PWA) or mobile app, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. Acceptance is mandatory and electronically recorded at the time of registration, including date, time, and document version. If you do not agree to any provision, do not use the service. Use is permitted only by individuals who are at least 13 years of age. Users under 18 must have parental or guardian consent.

    2. Eligibility and Minimum Age

    PREPULSE is not intended for persons under 13 years of age (in compliance with COPPA). Additionally, PREPULSE requires all users to be at least 14 years old. By creating an account, you declare that you are at least 14 years old or have express authorization from a parent or legal guardian if you are between 14 and 17 years old. PREPULSE reserves the right to terminate accounts that violate this restriction without prior notice and without refund.

    4. Description of Service

    PREPULSE is a digital study planning and performance tracking platform available as a Progressive Web App (PWA) installable on mobile devices and desktops. It uses algorithms and artificial intelligence to: create personalized study schedules supporting up to 3 active plans simultaneously; monitor performance through metrics; generate strategic analysis; suggest schedule reorganizations; offer flashcards with spaced repetition for active recall; manage collaborative study groups; and provide support through the ORBI AI assistant. The AI serves as an educational support tool and does not replace teachers, educational institutions, or professional guidance.

    5. No Guarantee of Results

    PREPULSE is an organizational and strategic tool. We do not guarantee passing any exam, test, certification, or assessment of any kind, including but not limited to the SAT, ACT, AP Exams, LSAT, MCAT, GMAT, GRE, Bar Exam, CPA Exam, or any professional certification. Performance depends exclusively on the user's effort, discipline, and individual circumstances.

    6. User Account

    To use the service, you must create an account providing: full name, date of birth, email, and country. The process includes mandatory email verification, age verification, and mandatory acceptance of the Terms of Service and Privacy Policy (electronically recorded). The study plan is created separately in the "Plans" tab. You are responsible for maintaining the confidentiality of your credentials and the accuracy of your information.

    7. COPPA Compliance

    In compliance with the Children's Online Privacy Protection Act (COPPA), PREPULSE does not knowingly collect personal information from children under 13 years of age. Our registration process verifies the user's age through date of birth validation. If a user is determined to be under 13, registration is blocked. If we discover that we have inadvertently collected information from a child under 13, we will promptly delete such information. Parents or guardians who believe their child has registered should contact preppulse.help@gmail.com for immediate account removal.

    8. Acceptable Use

    You agree not to: (a) use the service for illegal purposes; (b) attempt to access other users' data; (c) interfere with the security or operation of the platform; (d) copy, resell, or sublicense the service; (e) use reverse engineering or automated mechanisms without authorization; (f) use the AI assistant for any purpose other than study planning and performance tracking. Violation may result in account suspension or termination.

    9. Subscription, Free Trial & Payments

    PREPULSE offers a 7-day free trial starting from account creation. No credit card is required for the free trial. After the trial period, continued access to premium features requires a paid subscription. PREPULSE offers two subscription types:

    • Monthly: recurring monthly charge at $6.99/month (USD). Cancellation is available at any time, effective at the end of the paid period.
    • Annual: single annual payment of $59.99/year (USD) with discount. Cancellation is possible at any time; however, there is no pro-rata refund for unused months, except as required by applicable law. The user retains access until the end of the annual paid period.

    All prices include applicable taxes. Payments are processed securely through Stripe. Subscriptions automatically renew unless cancelled before the end of the billing period.

    10. Platform Features

    10.1 Study Plans: Users can create up to 3 simultaneously active study plans with subjects, availability schedules, and independent study methods.

    10.2 Flashcards: Active recall system with spaced repetition (SRS). Cards are organized into Decks linked to subjects. The system offers 3 review modes: Smart (based on SRS due dates), By Subject, and Simulated. Each review is rated at 4 levels (Again, Hard, Good, Easy) that automatically adjust the repetition interval. Flashcards can be shared with Study Groups or individually. Content remains owned by the creator and can be revoked at any time.

    10.3 Study Groups: Users at Level 2+ or with 2+ referrals can create study groups (max 20 members) for collective progress tracking via daily check-ins and flashcard sharing. New members enter with pending status and must be approved by the admin. There is no chat functionality. Each member controls their privacy settings. Upon leaving a group, progress data becomes invisible to other members.

    11. AI Disclaimer

    The ORBI AI assistant is designed exclusively for study planning assistance, performance analysis, and schedule optimization. It does NOT: provide answers to exam or test questions; serve as an academic tutor; replace professional educational guidance; guarantee any specific outcomes. AI-generated suggestions are informational only and should not be relied upon as the sole basis for academic decisions. Users acknowledge and accept that AI recommendations may contain errors or inaccuracies.

    12. Intellectual Property

    All content, features, and functionality of PREPULSE — including but not limited to text, graphics, logos, algorithms, and software — are owned by Jornada Eletrônica and protected by U.S. and international copyright, trademark, and other intellectual property laws.

    13. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PREPULSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR ACCESS TO OR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

    14. Indemnification

    You agree to indemnify, defend, and hold harmless Jornada Eletrônica and its affiliates from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the service or violation of these Terms.

    15. Governing Law & Dispute Resolution

    These Terms shall be governed by and construed in accordance with the laws of the United States and applicable state laws. Any disputes arising under these Terms shall first be attempted to be resolved through informal negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Class action lawsuits and class-wide arbitrations are not permitted.

    16. California Consumer Rights

    California residents have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). For details on these rights and how to exercise them, please refer to our Privacy Policy (US).

    17. Modifications

    We reserve the right to modify these Terms at any time. Material changes will be communicated through the application or by email at least 30 days in advance. Continued use after changes take effect constitutes acceptance of the revised Terms.

    18. Account Deletion

    You may delete your account at any time through the Settings page. Upon deletion, all personal data will be permanently removed within 30 days, except where retention is required by law. Active subscriptions will be cancelled and access will continue until the end of the paid period.
